Operating Procedures

WHEREAS, Lake-O-Pines landowners are the owners of real property in
The County of Jackson, State of Mississippi, described as follows:
The Lake-O-Pines Subdivision, First Unit, in Section 28
and 29, Township 5 South, Range 7 West, as per plat thereof
recorded in Plat Book 9, Page 33, of the Records of Plats on
file in the office of the Chancery Clerk of Jackson County,
Mississippi.
1. Meetings will be held as required.
a) The president is responsible to call the meetings.
b) Meetings can be held at the request of five (5) or more members.
2. Annual meeting shall be held during the month of April.
a) Officers are to be elected at the annual meeting.
b) Members shall be given a 7 day notice of said meeting.
c) A quorum for the meeting shall consist of the members present.
d) Proxies will be accepted, opened, and included in the vote count.
3. The officers of the corporation will consist of:
a) President
b) Vice-President
c) Secretary
d) Treasurer
4. The President or Vice-President will preside at all meetings.
5. Any elected officer will have two or more years of LOPLC service.
6. A financial statement will be provided orally at all meetings.
a) The amount of annual dues will be established at the annual meeting.
b) Taxes for Lake O Pines Property will be paid annually.
7. Membership
a) Any landowners within the boundaries of the Lake O Pines subdivision are eligible for membership.
b) Members shall be assessed $75.00 for a two (2) member family and $40 for a single member family.
c) Non-Lake O Pines property owners who wish to use the lake will be considered on a case-by-case basis by a majority vote of the LOPLC officers. The non-LOPLC members approved will be assessed an annual fee of $100.
d) During LOPLC business meetings, membership of households that pay $40.00 in dues receive 1 (one) vote. Membership of households that pay $75.00 in dues receive 2 (two) votes. However, only members present or voting by proxy can count in the vote.
e) Annual dues established at the annual meeting in April are due at the time of the meeting.
8. Any operating procedure may be amended or repealed by a quorum vote of members.
9. All meeting notifications will be posted on the website and by posting of signs.
Function of the Corporation and Lake Restrictions
The function shall be to preserve and maintain all properties owned by the Corporation and shall include the following:
1) Upkeep of the dam shall be maintained to State Standards.
2) The dam shall be closed to all gasoline powered vehicular traffic, including ATVs, except for maintenance of the dam.
3) The boat ramp on Lake Drive West is considered the primary boat ramp for launching watercraft by dues paying members.
4) No hunting is allowed on the lake.
5) All Lake O Pines boating and recreation on LOPLC properties shall stop at sunset. This includes the dam and boat ramp areas.
6) Fishing on the lake is restricted to members and their guests. If challenged by a LOPLC member, the member or guest challenged must present the proper membership identification. This includes the dam and boat ramp areas.
7) Wharves or piers shall not extend beyond 30 feet into the lake.
8) No gasoline driven craft may be used on the lake, nor boats with gasoline engines that are attached but not used.
9) No boats, kayaks or any other watercraft may be left overnight on any LOPLC property or on LOPLC property owners’ property without their approval. Boats, kayaks or other watercraft in violation will be towed at owner’s expense.
10) Anyone caught defacing or destroying Lake O Pines Corporation Property will be held accountable for repair or replacement. In the event of a minor’s involvement, the parents will be held accountable for repair or replacement.
